LAND SALE NOTICE In obedience to Judgments/Orders of the Chancery Court at Jonesborough, Tennessee, in the above-styled cause, I will on Saturday the 25th day of February, 2016, beginning at 10:01 a.m. and ON THE PREMISES, SELL, the Defendant’s life estate interest in that property described as 235 Fordtown Road, Fall Branch, Tennessee 37656 on a credit of not less than six (6) month, nor more than 2 years, and upon confirmation by the court, without the right of redemption or equity of redemption, with all faults, and subject to raised bids and the Judgments/Orders entered in the above captioned cause, to the best and highest bidder, the real property interest described herein, filed in the above referenced cause, and located in the 7th Civil District of Washington County, Tennessee. Address: 235 Fordtown Road, Fall Branch, TN 37656. Pursuant to the orders of the Chancery Court for Washington County, at least and specifically the ORDER, filed January 4, 2017, and entered in Minute Book 348, Page 20-22. Sarah Lawson is ordered to sell, as Special Master, the real property, described as follows: BEGINNING at a stake in the Fordtown Road, corner to Jack Archer; thence with his line, South 50 deg. East 765 feet to a stake; thence South 6 deg. West 340 feet to a stake; thence a new line, North 48 deg. West 1020 feet to a stake in said road; thence with said road, North 56 deg. 45 min. East 231 feet to a stake; thence North 55 deg. 30 min. East 20 feet to the place of BEGINNING, and containing five (5) acres, more or less, as surveyed by H. W. Tomlinson, Surveyor, on March 4, 1966. BEING the same property deeded to Paul P. Stacy by Deed dated October 29, 1990, recorded in Deed Book 698, page 124 made subject to that life estate interest vested in Mildred L. Stacy by Last Will and Testament of Paul P. Stacy, in Will Book 65, page 171, in the Chancery Court for Washington County, Tennessee. This conveyance is made expressly subject to all covenants, conditions, restrictions and reservations contained in former deeds and other instruments of record applicable to said property insofar as same are presently binding thereon and to any easements apparent from an inspection of the property. Sale of real property will be made 10% down day of sale with the remainder paid on or before thirty (30) days from the date of sale. Any judgment liens against the property shall be paid from the proceeds of the sale and may affect the reserve price on the day of sale.
PROPERTY WILL BE SOLD “AS IS” WITH NO WARRANTIES, AND WITH NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION OF THE REAL PROPERTY, AS WELL AS SOLD SUBJECT TO ANY LEASEHOLD INTEREST(S) AND/OR ANY OTHER AGREEMENT(S). Said property will also be sold subject to all rights-of-way and easements, applicable building/zoning regulations, any restrictive covenants, as well as any defects including structural defects and/or contamination, if any, which may exist.
